TN VISAS FOR CANADIAN NATIONALS
If you have an university degree (or the appropriate license and experience in some cases) and have a job that fits into one of the TN profession categories below, TN status is a great vehicle for living and working in the U.S. Even better, because Canadians are visa exempt, you do not have to apply for a TN visa from a U.S. consulate, but can instead make your application directly at the border or at an pre-flight inspection center at a Canadian airport.

TN VISAS FOR MEXICAN NATIONALS
TN visas are great options for Mexican professionals. The requirements are the same as they are for Canadians except that Mexican nationals must first apply for a TN visa at a U.S. consulate abroad before entering in TN status.

BACKGROUND INFORMATION ON TN STATUS IN THE U.S.
TN status is a product of Treaties between the U.S., Mexico and Canada and enables Canadians and Mexicans to enter the U.S. “to engage in business activities at a professional level” in one of the professions set forth the professions list below.
“Business activities at a professional level” are defined as “those undertakings which require that, for successful completion, the individual has a least a baccalaureate degree or appropriate credentials demonstrating status as a professional in a profession set forth in the list below. Most of the TN professions require at least a Bachelor’s degree; however some do not including Management Consultants and Scientific Technologist, though each of these categories have their own specific experience requirements.
The TN visa has a number of advantages over the H-1b visa, including:
- There is no numerical limit on the number of TNs granted each year
- While TN status is a non-immigrant status, there is no statutory limit on the duration one can hold TN status
- There is no LCA (Labor Condition Application) requirement
In summary, the requirements to qualify for a TN visa are:
- You are a citizen of Canada or Mexico
- Your profession qualifies under the regulations
- The position in the United States requires a NAFTA professional
- You have a prearranged full-time or part-time job in the United States (but not self-employment)
- You have the qualifications to practice in the profession in question
