New DHS Secretary Kelly Clarifies Order Regarding Effect on Lawful Permanent Residents

Two pieces of good news have come so far since Trump’s unconstitutional travel ban. First, a federal court has granted an injunction, barring the government from deporting individuals being held under the injunction for two weeks (while a final decision is reached on the lawsuit).

Second, new DHS Secretary Kelly fixed a portion of the order, stating that the admission of lawful permanent residents (“green card holders”) will be presumed to be in our national interest, absent factors suggesting otherwise.

Insights into the Trump Administration

This fix by Kelly reveals a couple things. First, the White House and its advisers simply drafted an order without fully understanding its scope or immigration law. And second, DHS clearly was not consulted to any significant degree, or they would not be fixing the mistake in the order that ensnared lawful permanent residents.

Well, we cannot be surprised that President Trump is capable of making rash decisions with very little vetting and analysis by the subject matter experts.

Secretary Kelly’s full statement regarding Lawful Permanent Residents

“WASHINGTON—In applying the provisions of the president’s executive order, I hereby deem the entry of lawful permanent residents to be in the national interest. Accordingly, absent the receipt of significant derogatory information indicating a serious threat to public safety and welfare, lawful permanent resident status will be a dispositive factor in our case-by-case determinations.”
